Do you need a permit or HOA approval to replace windows in Dallas?
In most Dallas–Fort Worth cities, yes, window replacement requires a building permit, and that includes a like-for-like swap with no change to the opening. If your home is in an HOA, written architectural approval normally has to come before the city permit, particularly when the frame color, grid pattern, or glass tint changes.
Why cities permit a window swap at all
It looks like cosmetic work, but window replacement touches three things a building official cares about:
- Egress. Bedrooms require an operable window meeting minimum clear opening dimensions so a person can get out and a firefighter can get in. Some replacement units, particularly inserts that shrink the opening, can make a compliant bedroom non-compliant.
- Safety glazing. Tempered glass is required near doors, tubs, showers, stair landings, and any pane close to the floor. A retrofit that puts annealed glass in one of those locations is a code violation and a real hazard.
- Energy code. Texas has adopted an energy code with maximum U-factor and SHGC values for replacement fenestration. Permitting is how compliance gets verified.
Requirements and fees vary by city, so the answer for Dallas is not automatically the answer for Fort Worth, Plano, or Highland Park. Some cities process online in a day, some take a couple of weeks, and the Park Cities have their own expectations. Confirm with your city, or let your contractor do it.
The real risk of skipping the permit
Nobody inspects your windows on a Tuesday afternoon. The problem shows up later:
- At resale. Unpermitted work surfaces during the buyer's inspection and title work, and it becomes a price negotiation or a repair demand at the worst possible moment.
- On a claim. An insurer can push back on damage tied to unpermitted work.
- With the city. Retroactive permitting costs more, and if the installed windows do not meet egress or glazing requirements, the fix is new windows.
A contractor who suggests skipping the permit to save you a few hundred dollars is optimizing their schedule, not your outcome.
HOA approval, which is usually the slower half
If you are in an HOA with an architectural control committee, its approval typically has to be in hand first. Committees care about things a city does not:
- Frame color, especially any change from white to bronze, black, or almond
- Grid or muntin pattern, and whether grids are kept, dropped, or changed
- Whether the visible frame profile matches neighboring homes
- Reflective or heavily tinted glass, which many HOAs restrict outright
- Consistency across the street-facing elevation

What a clean HOA submittal contains
- A completed architectural request form from your management company
- Manufacturer specification sheets for the exact product line
- Color and finish selection, exterior and interior
- Grid pattern drawing, if grids are involved
- Photographs of the existing elevations
- A short scope letter: what is being replaced, with what, and by whom
Six items. Most rejections we see are not aesthetic disagreements, they are incomplete packets that sit for a cycle and then come back asking for a spec sheet.
Historic districts
If you are in a designated historic district, the rules are stricter and the review is a separate process from the standard permit. Vinyl is often prohibited outright on street-facing elevations, and repair of the original units may be required over replacement. Start that conversation before you shop for windows, not after.
